India Pushes Stronger Compliance Framework for Meta, Google, and X

India is advancing its digital regulatory framework by proposing amendments to its IT laws that would make government advisories and clarifications legally binding on major technology platforms such as Meta, Google, and X. The move represents a shift from advisory-based guidance to enforceable compliance, aimed at strengthening oversight of digital platforms.

Under the proposed changes, platforms would be required to adhere strictly to government-issued directives on issues including content moderation, AI-generated material, and deepfakes. Until now, such advisories have functioned primarily as guidance without direct legal consequences.

A key aspect of the regulatory push is the significant reduction in response timelines. The government has already shortened the window for removing flagged content from 36 hours to just 3 hours, signaling a stronger emphasis on rapid action and accountability in addressing harmful or sensitive content.

The proposal also introduces stricter consequences for non-compliance. Platforms that fail to follow binding advisories risk losing their “safe harbour” protection, a legal safeguard that currently limits their liability for user-generated content. Losing this protection would expose companies to greater legal risk and accountability.

These developments come amid increasing focus on the risks associated with AI-generated content, including misinformation and deepfakes. The government has been introducing new obligations to ensure transparency and responsible usage of such technologies across digital platforms.

The initiative reflects a broader effort by the government, led by Narendra Modi, to enhance regulatory clarity and strengthen enforcement mechanisms in the rapidly evolving digital landscape. As India’s digital economy continues to grow, these measures aim to align platform operations with national priorities while fostering a more accountable and secure online ecosystem.

With this proposed shift, India is positioning itself as a proactive regulator in the global technology space, seeking to balance innovation with responsibility and ensure that digital platforms operate within a clearly defined legal framework.
